LETHBRIDGE: A sentencing date has been set for Lola Ann Leavitt, nearly four years after she was first charged with fraud and theft.
In June of 2007 Regional Police received a complaint that an employee was taking money from the London Road Market, and Leavitt was charged in September.
It's alleged she took over $217,000 between 2001 and 2007.
Her sentencing has been pushed to June 17th so medical experts can provide testimony that will help the court decide whether Leavitt's eligible for a conditional sentence, also known as house arrest.
Her lawyer Greg White explained that she suffers from COPD (Chronic Obstructive Pulmonary Disease) as well as anxiety, something the medical experts will address. He stated that because of those issues he will likely be pushing for the conditional sentence.
It was clear during Wednesday's appearance that Leavitt is very frail, having oxygen tubes running into her nostrils.
